710 § 1 Scope of application The following General Terms and Conditions (Consumer GTC) apply to busi- ness affairs when a sale is being made to the consumer as specified by § 13 of the German Civil Code. A consumer is any natural person who enters into a legal transaction for a purpose which is neither of commercial nor inde- pendent vocational interest. Tel.: +49 521-934170 , Fax: +49 521-9341710, E- mail: info@torwegge.de . § 2 Conclusion of contract All offers for delivery of goods on the web site www.torwegge.de or in cata- logs represent only a request for quotation by the customer. The contract with us is created when we accept the customer's offer in writing, but no later than upon delivery of the goods. If an order confirmation has been sent previously, this does not constitute acceptance of the offer. We will ac- cept the offer from the customer unless the ordered goods or services are not available. The customer shall be informed whenever we are not able to accept the customer's offer. § 3 Prices and payment conditions The prices are in euro; they include VAT and other price components. The shipping costs depend on the amount of goods ordered, the shipping location and the type of shipping. Costs shall be clearly communicated to the customer before making a binding order. The purchase price, including shipping costs, shall be due at the conclusion of the contract. Deliveries are usually made within 5 days, unless expressly stated otherwise. § 4 Retention of title The delivered goods remain our property until payment of the purchase price is made. § 5 Offset charges The customer is only entitled to offset charges when the customer's coun- ter-claims have been legally established, are undisputed or acknowledged by us. The customer is only entitled to rights of retention when they are based on the same contractual relationship. § 6 Costs of return shipments If, for a distance sales contract, the customer chooses to exercise his statu- tory right of withdrawal, as described in § 7, he is obliged to bear the cost of returning the goods when the delivered goods correspond to the order and when the price of the returned goods does not exceed an amount of € 40.00, or, when the price is higher, the customer has not, at the time of cancellation, made the payment or a contractually agreed partial payment. Otherwise the return shipment shall be free of charge for the customer. § 7 Right of revocation Conditions of cancellation or revocation You can cancel your contract in writing (e.g. letter, fax, e-mail) within 14 days without stating a reason, or by sending the goods back before the deadline has expired. The withdrawal period starts when this information is received in writing for the delivery of goods, but not prior to the receipt of the goods by the consignee (where similar goods are delivered on a recurring basis, then not before receipt of the first partial delivery), not before the close of contract when services are rendered, upon delivery of goods and services and also not prior to performance of our duties of disclosure pursuant to Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 of the introduc- tory German Civil Code, as well as our duties pursuant to § 312e, paragraph 1, sentence 1 of the German Civil Code in conjunction with Article 246 § 3 of the introductory German Civil Code. The timely dispatch of the revocation of the goods shall be deemed suf- ficient for compliance with the revocation term. In the case of services performed, this may still require you to meet your payment obligations for the period until the revocation was made. If you are unable to return the received benefits in their entirety or partially, or only in a diminished state, you shall be obliged to pay us com- pensation for the value lost. In the event of a diminished condition or de- rived benefits, you shall only be obliged to compensate for lost value when the uses or deterioration is due to your own handling, beyond any basic examination of properties and functioning. The term "examination of the properties and functioning" refers to the processes of testing and trying out the goods, as is possible and customary in a retail store. Transportable items shall be returned at our risk. You shall bear the cost of returning the goods if the delivered goods correspond to the order and if the price of the returned items do not exceed an amount of € 40, or, when the price is higher, you have not, at the time of cancellation, made the pay- ment or a contractually agreed partial payment. Otherwise you shall not be obliged to pay for the return. You shall pick up any items which cannot be shipped. Obligations to reimburse payments must be fulfilled within 30 days. This deadline period begins for you when you send your revocation/ cancellation or when we receive the items. Special note Your right of revocation shall expire prematurely if the agreement, at your express request, has been executed in full by both parties prior to your exer- cising your right of revocation.
